1 I hereby agree that by entering the premises known as Apex Strength and Conditioning Limited, (hereinafter referred to as “Apex Gym”) that I am entering an area where there are machines which may cause injury to myself and / or other patrons and / or members of “Apex Gym” if they are not used in the correct manner associated with the specific purpose for which they have been designed.
2 I further acknowledge that I have a duty of care to myself and other patrons and / or members of Apex Gym, to use these machines for the purpose, and in the manner which they were properly designed for, and in the event that I do not know how to use the said machines, I will seek and obtain instruction regarding the proper use of the said machines, from a qualified member of staff employed and / or retained by Apex Gym.
3. I fully understand that injury to both myself and others may occur as a result of the negligent use of any of the machines contained in Apex Gym, and where such injury occurs in a situation where, but not limited to:
- I have not sought proper instruction from a member of staff in relation to how a machine should be used,
- I have used a machine in a manner that can be construed by a reasonable observer as being dangerous to myself, or to another patron / member of Apex Gym,
- I have used a machine in a manner that might be reasonably construed as such that would cause damage to that machine,
- I have used a machine in a manner likely to cause injury to myself or any other person / patron of Apex Gym,
- I have caused damage to a machine as a result of the negligent manner in which I have used that machine, or
- I have ignored the instructions of a qualified member of staff employed and / or retained by Apex Gym regarding the use of a machine on the premises,
4. I agree that I am fully responsible for any injuries sustained by me, and the cost of repair of any of the machines that I use at Apex Gym, as a result of the refusal to seek instructions regarding the proper use of that machine, or any injuries that might necessarily occur as a result of the negligent manner in which I used the said machines.
5. I further understand that I am entering an area that has free standing weights, plate loaded machines and other machines that have moving and / or rotating parts, and I undertake and recognise that it is my responsibility not to over exert myself by lifting items that are beyond my capability, or use machines that are beyond my level of fitness, and I accept full responsibility for any injuries that I may sustain as a result of over exerting myself, or pushing myself beyond my fitness capabilities.
6. I further agree that where such an injury occurs, I will notify a member of Apex Gym immediately upon sustaining the said injury and I will desist from any further exercise / training until the injury has been fully investigated and assessed.
7. I further agree that where I have used a machine and / or engaged in any type of behaviour which might necessarily be construed by a staff member of Apex Gym, as behaviour that would be likely to cause me injury, or cause injury to other patrons and / or members of Apex Gym, the management and / or staff or Apex Strength and Conditioning Limited reserve the right to suspend, cancel, and / or terminate my membership of Apex Gym wholly and entirely at their discretion.
